Caleb Grant was charged with felony counts of assaulting a peace officer, resisting arrest, and carrying a loaded gun in public, and misdemeanor charges of resisting arrest and possessing marijuana for sale. Grant remained hospitalized for his first scheduled court appearance, on May 28, and hadn’t yet been booked in jail, according to court records. The minute order from the court hearing says he was appearing remotely and being “assisted by Oakland police.”
At the hearing, Judge Thomas Reardon signed an order releasing Grant without bail, and said the subject of his booking will be dealt with later, court records show. He is next due in court on June 12.
The charging records allege that police pulled Grant over for a “moving violation” at around 3:10 a.m. May 8 on the 1300 block of 9th Avenue. Police said they observed him trying to pull out a gun from inside his car. The officers — identified as Ariel Gonzalez-Martinez and Sione Fili — attempted to pull Grant out of the car and arrest him.
Grant allegedly accelerated, dragging Gonzalez-Martinez into his car. The officer then allegedly shot Grant once, wounding him.

Police said at the time of the incident that both officers were briefly hospitalized as well.
Police say they found a gun in Grant’s car, which had been reported stolen in a 2025 Oakland home burglary. A “large quantity of marijuana” was found in Grant’s car and a “large” amount of cash was found on his person, authorities said in court filings.
The shooting was the second involving Oakland officers in a three-week span. On April 27, Oakland police shot and killed a man who allegedly pointed a gun at them. There have been four other reported Oakland police shootings since February 2023.
