As the case is rendered a homicide, no further information is available, and all inquiries will need to be directed to the investigating law enforcement agency.”

The San Jose Police Department acknowledged the autopsy finding, but when asked if the autopsy finding has prompted the identification or arrest of anyone suspected in the child’s death, declined additional comment, including on whether they have pivoted their initial death investigation to a homicide probe.

“We are aware of the Medical Examiner’s report and the investigation is ongoing,” the police department said in a statement to this news organization.

The Santa Clara County Department of Family and Children’s Services did not immediately respond to a request for comment.

Aurora was found dying the morning of May 13 at the San Jose home she shared with her mother, siblings and other adults, a squalid house to which Santa Clara County child welfare authorities had been summoned in response to multiple reports from school officials, police and others that she and the other children were malnourished and neglected.

The children had been the subject of eight referrals to social workers in recent years, but in each case, they were determined to be unfounded or inconclusive, according to county Supervisor Sylvia Arenas, a critic of the child welfare agency that she contends focused more on keeping families together than on ensuring children’s safety.

The release of Aurora’s cause and manner of death comes as the county’s Department of Family and Children’s Services remains under heavy scrutiny and 18 months of state-mandated reforms after at least six child deaths in recent years. Those include infant Phoenix Castro, who was 3 months old when he died in 2023 of a fentanyl overdose in her home, and 2-year-old Jaxon Juarez who died in April after being placed in the foster home of his cousins where authorities say he was repeatedly sexually assaulted.

Parental neglect contributed to three of those six deaths in 2022, all children who had been the subject of repeated referrals urging the county’s child welfare agency to intervene, according to a report by the Child Death Review Team led by the county coroner. After the release of that report, the child welfare agency agreed to provide the Child Death Review Team comprehensive fatality reviews on every case with a history of abuse or neglect referrals.

Read more Federal judge postpones ruling on halting ICE facility construction near Gilroy

Jorden said Aurora died after an asthma attack — her brain was deprived of oxygen — while fighting a viral infection that had cold and flu-like symptoms. Two days after the May 13 emergency call, SJPD investigators, clad in body-length protective gear, could be seen carrying boxes out of the girl’s home while serving a search warrant.

At least one of the police calls about the home voiced concern that Aurora and another child were malnourished and appeared to be getting most of their nutrition at school. The sources also said that the county Department of Family and Children’s Services visited the home — occupied by seven children and six adults — and found no cause to take action.

To this point, the county agency has declined to specify its involvement with or supervision of Aurora and her family, acknowledging only that they were “actively investigating the circumstances around this tragedy” alongside authorities.

In response to a public records request, SJPD disclosed data to this news organization showing that Aurora’s home had been the subject of at least six welfare check requests in the past five years, but those records do not specify who was involved, or the outcome. County court records do not show serious criminal histories for current or recent residents at the home, but five juvenile dependency cases were opened two days after Aurora was last taken to the hospital, presumably involving some of the children still living there.

When Jaxon died, the state Department of Social Services was wrapping up 18 months of oversight of DFCS stemming from the death of Baby Phoenix, who was allowed to remain in her father’s care despite his history with substance abuse and neglecting his older children and warnings from a social worker involved with her family that she wouldn’t be safe at home.

Now, the agency, county leaders and child-welfare experts and advocates are grappling and finger-pointing over whether a tripling of child removals since Baby Phoenix died is an overcorrection to the myriad controversies and high-profile tragedies.

Read more SEC and LSU on the brink: The expulsion vote, an ulterior motive, Lane Kiffin’s next move and what the showdown means for everyone else

This is a developing story.
